1. Who we are
Modern Digital Skills is a sole proprietorship registered in Kenya, operating from Westlands, Nairobi. In these terms we are referred to as "we," "us," or "Modern Digital Skills." You — the person buying or using our courses — are referred to as "you," "the student," or "the user." The website moderndigitalskills.com and any sub-pages, dashboards, or course platforms operated by us are referred to as "the Platform."
2. Acceptance of these terms
By creating an account, enrolling in any course, or paying for any service on the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms of Service, our Refund Policy, and our Privacy Policy. If you do not agree with any part of these terms, you must not use the Platform.
You must be at least 18 years old to enrol independently. If you are under 18, you may only enrol with the consent and supervision of a parent or legal guardian.
3. Your account & access
When you enrol in a course, your name, email, and phone number are stored in our system and used to grant you access to that course. You agree that:
- The information you provide at enrolment is accurate and belongs to you.
- Your access (whether through a one-time access link, browser session, or email sign-in) is for your personal use only.
- You will not share your access link, account, or login email with anyone else.
- You will not allow another person to watch the lessons through your account.
We reserve the right to revoke access without refund if we detect account sharing, multiple simultaneous sessions from different locations, or any other abuse.
4. Course content & intellectual property
All course content — videos, written materials, slides, downloadable files, dashboards, designs, and any other material on the Platform — is owned by Modern Digital Skills (or licensed to us by the original creator) and is protected under Kenyan and international copyright law.
When you pay for a course, you receive a limited, personal, non-transferable, non-exclusive licence to access and view the content for your own learning. You do not receive any ownership, reproduction, or distribution rights. Specifically, you may not:
- Download, screen-record, copy, or save the course videos by any means.
- Re-upload course content to YouTube, social media, file-sharing sites, or any other public platform.
- Resell, sub-licence, rent, lend, or otherwise commercialise the content.
- Use any automated tool, scraper, or bot to access or extract content.
- Use the content to train, fine-tune, or build any machine-learning, AI, or competing course.
Violation of these rules will result in immediate revocation of access without refund and may lead to legal action.
5. Payments
All payments are processed by Paystack, a third-party payment processor. By paying through our Platform you also accept Paystack's own terms of service. All course prices are displayed in Kenyan Shillings (KES) and are inclusive of any applicable taxes unless stated otherwise. Once payment has been confirmed by Paystack and we have provisioned your access, the transaction is complete and is governed by our Refund Policy.
6. Acceptable use
You agree to use the Platform in a way that is lawful and respectful. You may not:
- Attempt to gain unauthorised access to any part of the Platform, accounts, servers, or networks.
- Probe, scan, or test the vulnerability of the system.
- Use the Platform to send spam, harass others, or upload malicious code.
- Use the Platform for any unlawful purpose under Kenyan law.
7. Availability & updates
We work hard to keep the Platform available 24/7 but we do not guarantee uninterrupted access. From time to time, planned or emergency maintenance, third-party outages (e.g. our hosting provider, YouTube, or Paystack), or events outside our control may interrupt access. We are not liable for losses caused by such interruptions.
We may update, change, or improve any part of the Platform — including course materials, prices, and features — at any time. We will not roll back prices already paid by enrolled students for content they have already purchased.
8. Disclaimers
The courses on the Platform are educational. We teach practical digital skills, business ideas, and earning strategies. We do not guarantee any specific income, job, client, or business outcome from taking our courses. Your results depend on your effort, your market, and many factors outside our control.
Nothing on the Platform constitutes financial, legal, or professional advice. You should consult a licensed professional before making any major financial or business decision.
9. Limitation of liability
To the maximum extent allowed by Kenyan law, the total liability of Modern Digital Skills to any user under any claim arising out of the use of the Platform — whether in contract, tort, or otherwise — is limited to the amount that user paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential losses including lost profits, lost data, or lost opportunities.
10. Changes to these terms
We may update these terms from time to time. The "Effective from" date at the top of this page will reflect when the latest version took effect. Continued use of the Platform after an update means you accept the new terms. Material changes will be highlighted on the Platform or sent to your registered email.
11. Governing law & disputes
These terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or in connection with these terms will first be addressed by good-faith discussion between the parties for at least 30 days. If unresolved, the dispute will be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
